These terms govern individually agreed business data exports by Martin Adamec. We serve business customers. Mandatory protections, including those applicable to qualifying sole traders, remain unaffected. Individually agreed terms take priority where lawful.
An enquiry is nonbinding. Before acceptance, our written quotation specifies scope, countries, filters, data fields, format, number of records or agreed estimate, data reference date, price, currency, taxes, payment, delivery, licence and applicable terms. A contract arises through acceptance of the quotation on the terms agreed in writing; no standard acceptance period is imposed here.
We supply the export described in the accepted quotation. Updates and recurring services require agreement. Public business information may change and fields may be missing; the quotation must describe relevant limitations. These limitations do not remove statutory rights concerning a nonconforming delivery. We do not guarantee contact reachability, marketing consent, responses or sales results.
Price, currency, tax treatment, payment method and due date are agreed individually in the written quotation. There is no automatic requirement for advance payment or fixed payment period. Applicable statutory rules govern matters not agreed. Prices on this website are stated in pounds sterling (GBP). TO CONFIRM: VAT treatment of services supplied by a Czech provider not registered for VAT to UK businesses (tax adviser).
The delivery date, file format and delivery method are agreed in the written quotation. Any download availability period is stated before acceptance. Delivery delays or technical problems should be reported using the contact details below; statutory remedies remain available.
The quotation specifies permitted use, recipients, onward sharing and any licence restrictions before acceptance. Rights in a compilation are asserted only to the extent protected by law; we do not claim ownership of public facts. Third-party source rights and licences remain applicable. Delivery does not itself authorise processing of personal data or advertising.
Each party remains responsible for its own processing. Customers must establish a lawful basis, meet information duties (Art. 14 UK GDPR) and respect objections. Under the Privacy and Electronic Communications Regulations 2003 (PECR), marketing emails and texts to individual subscribers, including sole traders and partnerships in England, Wales and Northern Ireland, need prior consent or a soft opt-in (regulation 22(3)); emails to corporate subscribers must identify the sender and give a valid opt-out address. Live marketing calls must not be made to numbers registered with the Telephone Preference Service or the Corporate TPS or to subscribers who have objected (regulation 21); screening against TPS and CTPS before calling is the customer’s duty, and exports are not screened unless agreed in writing. Automated marketing calls need prior consent (regulation 19). Purchasing a list creates no consent. Customers keep their own suppression lists. Exports are intended for direct mail, CRM maintenance, B2B campaigns within PECR, market analysis and territory planning. Do not use exports for sensitive-personal-data profiling or consumer credit eligibility decisions.
Send the order reference and a description of the discrepancy to our contact address, with relevant examples where available. The written quotation individually specifies the agreed remedy, such as correction, replacement or an appropriate refund. Mandatory remedies remain unaffected; where no special remedy is agreed, applicable statutory rules apply. No shortened complaint or limitation period is imposed here.
Liability is governed by applicable law. These terms impose no contractual liability cap, blanket warranty exclusion, penalty or indemnity. A statement about data limitations is not a waiver of rights for breach of contract or other legally established liability.
Our privacy notices explain customer and database processing. Before an export containing personal data, the parties must assess their respective roles, legal bases, required safeguards and any international transfer requirements. A sale does not by itself establish lawful disclosure or make the customer a processor.
The service is directed at business use. This description does not remove mandatory cancellation, withdrawal or other rights that applicable law grants to a particular customer. Any individually agreed cancellation terms must respect those rights.
Applicable law and jurisdiction follow the relevant statutory conflict-of-law and jurisdiction rules unless a valid individual agreement provides otherwise. These terms impose no exclusive foreign court or arbitration clause. TO CONFIRM: choice of law (Czech law or the law of England and Wales) and place of jurisdiction for business customers in the United Kingdom.
The version supplied with the accepted quotation applies to that contract. Later website changes do not automatically amend existing contracts. If a provision is ineffective, applicable statutory rules govern; mandatory legal protections remain intact.
