What counts as Real estate and property management

The industry corresponds to division 68 of UK SIC 2007, real estate activities: buying and selling own property, renting and operating own or leased property, and agency and management on behalf of others.

Developers who have buildings put up are in 41.10, in construction, not here; add that class from Construction and building trades if you want them. Residents’ management companies of blocks of flats can file the Companies House code 98000 (residents property management), which lies outside division 68 altogether.

Agent rules differ between the four nations

Estate and letting agency is regulated differently in England, Scotland and Wales. Some registers can be searched online; none of them is a mailing list.

England: redress schemes
Anyone doing lettings agency work or property management work in England must belong to a redress scheme (art. 3 and art. 5 of the 2014 Order). National Trading Standards offers a Property Agent Checker to check an estate or letting agent’s redress scheme registration.
Scotland and Wales
Letting agents in Scotland must apply to the Scottish Letting Agent Register, which can be searched for an agent and its contact details. In Wales, anyone letting or managing property for others needs a licence from Rent Smart Wales, whose register can be searched by agent, landlord, address or reference number.
Money laundering supervision
Estate agency businesses, and letting agency businesses handling high-value lets, must register with HMRC under the money laundering regulations (who needs to register). HMRC’s Supervised Business Register gives name, trading name and the first part of the postcode, without phone or email.

Not in the export

  • current listings and asking rents or prices
  • owners of property-holding companies

Agent, manager or landlord: the class decides

Class 68.20 is large and mixed: besides housing associations it can contain companies that own just one or a few buildings and have no office of their own. If you serve managing agents, ask specifically for 68.32; making a website a required field helps to filter out pure holding companies.

An agency may handle sales, lettings and block management at once. In the statistics it appears under its main activity only, so a combined agency is found either in 68.31 or in 68.32, never in both.

An agency run as a limited company is a corporate subscriber: a B2B email needs no prior consent if you identify yourself and offer an opt-out. Sole-trader agents need consent or a soft opt-in, and every sales call must first be screened against TPS and Corporate TPS.

Questions

Real estate and property management: frequently asked questions

Yes, where a UK SIC code is available: class 68.32 covers management of real estate on a fee or contract basis. Agencies that also sell or let appear there only if management is their main activity.

Developers are in 41.10, in construction, and can be added to the same request. Companies that file the Companies House code 98000 (residents property management) fall outside division 68 and are not part of this industry.

A sales call is allowed only to a number that is not registered with TPS or Corporate TPS and whose subscriber has not objected to your calls (PECR reg. 21). Screening is the caller’s job. A letter is the simplest first contact. Details: PECR rules for B2B email and calls.
